Buying a Used Car in India? Don't Let Paperwork Ruin a Good Deal

You found the car. The price is right, the engine sounds healthy, and the seller seems trustworthy. Deal done, right?

Not quite. Here's a truth most first-time used car buyers learn the hard way: if the paperwork isn't sorted, the car isn't really yours — no matter how much you paid or how long you've had the keys.

Let's fix that before it becomes a problem.

First, Why Should You Even Care?

Because skipping paperwork doesn't save you money. It just saves the problem for later — and later, it's usually worse.

Picture this: you buy a car, skip the RC transfer, and six months down the line, a traffic challan lands at the previous owner's address. Now you're stuck in a back-and-forth that could've taken ten minutes to avoid. Or worse — you're in a minor accident, file an insurance claim, and it gets rejected because the policy was never transferred to your name.

A little paperwork now saves a big headache later.

Before You Pay: Do a 5-Minute Check

Before any money changes hands, glance at these:

  • RC (Registration Certificate): Does it match the car's engine and chassis number? Is it marked "hypothecated" (meaning there's a loan on it)?

  • Insurance: Is it active, and is it comprehensive or just third-party?

  • PUC Certificate: Valid pollution certificate, or expired?

  • Pending challans: A quick check on the Parivahan portal shows you this in seconds.

If anything looks off — mismatched numbers, an expired PUC, unresolved loan — it's not a dealbreaker, but it is a negotiation point (and a reason to slow down).

The Sale Agreement: Your Safety Net

A simple, signed sale agreement protects you if anything goes sideways later. It just needs the basics: both parties' details, the car's registration and chassis numbers, sale amount, odometer reading, and a line where the seller confirms there's no pending loan or legal issue on the car.

Takes five minutes to write. Saves you a lot more than that if there's ever a dispute.

The Big One: Transferring the RC

This is the step people put off — and shouldn't. Legally, it needs to happen within 14 days of the sale.

Here's what it involves, in plain terms:

You and the seller fill out Form 29 and Form 30 (transfer of ownership forms), and submit them along with the original RC, your ID and address proof, the insurance copy, PUC certificate, and the sale agreement. If there was a loan on the car, you'll also need an NOC from the bank and Form 35.

Many states let you start this online through the Parivahan portal, though you may still need one RTO visit to finish it. It can take anywhere from a couple of weeks to over a month — so start early, not when you're already trying to resell the car.

Don't Forget Insurance

Here's the part almost everyone forgets: the seller's insurance does not automatically cover you. Until the policy is formally transferred into your name ,(also within 14 days) any claim you file could be denied.

Two options: transfer the existing policy, or just buy a fresh comprehensive one if the old policy is close to expiry anyway. Either way — don't drive around uninsured-on-paper, even if the car feels perfectly insured to you.

The Mistakes That Cost People the Most

  • Paying in full before checking if there's a loan on the car

  • Trusting a verbal "don't worry, I'll sort the papers" instead of a signed agreement

  • Letting the RC transfer sit for months

  • Assuming old insurance just carries over

Every one of these is avoidable with about an hour of effort.

Bottom Line

A used car deal isn't really done at the handshake — it's done when the RC says your name, the insurance says your name, and there's a signed paper trail behind it. It's not glamorous, but it's what makes the car legally, fully yours.
